I also co-authored a book on elder law for long-term care planning with attorney Bradley Erdosi. In 2013, I released a book on business planning titled “Protecting You and Your Business, a Practical Guide for California Business Owners.” There are many common mistakes I’ve seen over and over again by business owners, and I wrote this book to help you avoid those mistakes. In 2015, I published “Protect Your Children’s IRA Inheritance ” which was inspired by a recent US Supreme Court case in June 2014, the Clark case. Many people have no idea that their large IRAs, 401(k)s or defined benefit plans could be taken from their children by a divorce, lawsuit, bankruptcy, or other creditor when they inherit these accounts. Those with special needs beneficiaries need to pay particular care to this issue because leaving a child who has a disability on their beneficiary form could bump that child off of government benefits when they inherit the account. Although we serve a wide range of clients within the estate planning, elder law and business law practice areas, the common thread throughout the practice is protection–protection of family members, children, parents, assets, and business interests in the Carlsbad and greater San Diego area. This may surprise you, but over 70% of all Americans have done no estate planning whatsoever. This means that if something happens to them, their family could be at risk for paying a lot more money to the government, tying their estates up in court for a long time and also that their children or other heirs have no protection around the assets that they inherit. And for those with minor children, their children could also be raised by someone they never wanted and their assets delivered to their children at the tender age of 18 through a probate.
